Oiler Board Terms of Use
These Terms govern the use of Oiler Board and of the OILER Account and also apply, as far as relevant, to anyone who uses Oiler Board without an Account.
1. Who we are
Oiler Board is provided by Luigi Bernardi («we»), whom you can contact at info@oiler.education. The same address is the point of contact for authorities and for users provided for by arts. 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act), in Italian or in English.
2. The Service
2.1 Oiler Board (the «Service») is a free online whiteboard for teaching. Some functions require an OILER Account, which is also free.
2.2 The Service is whatever you find at any given time, and you use it as it is. We may change it, add or remove functions, including those that require the Account, suspend it or close it, in whole or in part, at any time and without notice. We do not undertake to offer or keep any function, nor do we guarantee that the Service will be available, free of errors or suitable for your purposes.
2.3 In the future some functions, including some that are free today, may become paid. We will not charge you anything unless you choose to buy them, under separate terms of sale.
3. The OILER Account
3.1 To create the Account, you type your email in the form, which you can correct before sending it, accept these Terms and declare that you are at least 16. The contract is concluded when we create the Account. The first use of the access code confirms that the email is yours and counts as acceptance of these Terms. You can ask us for a copy of the Terms you accepted.
3.2 If you are under 16, the Account is created and held by a parent or guardian, with their own email: they may let you use it and are responsible for your use of it.
3.3 The Account is free, personal and not transferable, and each person may have only one. The only people you may let use it are the minor of whom you are the parent or guardian and pupils during your lessons.
3.4 You sign in with a code that we send you by email. Keep it secret: anyone who knows it can sign in as you, and you are responsible for the use made of it by anyone who got it from you. We may change the way of signing in and limit devices, sessions and requests.
4. Rules of use
4.1 You may use the Service for personal use, at school and in private lessons that you give yourself, including paid ones.
4.2 You may not:
- use it for unlawful purposes or to show or send content that is unlawful or infringes the rights of others, in particular those of minors;
- give or publish your code, let others use the Account outside the cases in art. 3.3, or sell, rent out or transfer it;
- access the Service by automated means, attack it, overload it or circumvent its protections and limits;
- copy, decompile or modify the software, except where permitted by law, integrate it into other products or offer it to third parties as a service.
4.3 Use only content that you have the right to use. You are responsible for what you create, show or send with the Service, which we do not check, and you shall indemnify us against any third-party claims arising from it.
5. Intellectual property
5.1 The software, the graphics and the content of the Service, and the OILER figurative trade mark, registered in Italy under no. 302018000027802 (class 41), belong to us or to our licensors; for third-party content, their licences also apply. We grant you only a personal, free-of-charge, non-exclusive and non-transferable right to use the Service under these Terms.
5.2 The work you create is yours. If it contains our content, you may use it in your teaching, including your private lessons, but you may not sell it or use it in commercial products without our written consent.
5.3 Oiler Board is a work conceived and created by Luigi Bernardi, who is its author and holds all rights in it. It may be used and reproduced, in whole or in part, only for teaching purposes and in accordance with art. 4; in talks, conferences and publications it must always be cited as «Oiler Board by Luigi Bernardi».
6. Liability
6.1 You use the Service at your own risk. Checking the content you show is up to you.
6.2 Your work and your images stay on your devices: we keep no copies of them and cannot recover them. Saving them is up to you.
6.3 To the fullest extent permitted by law, we are not liable for any damage connected with the Service or the Account, with their use or with being unable to use them, including loss of work, images or data, interruptions, changes, suspension and closure, and we owe you no refunds, compensation or indemnities of any kind. This does not affect liability for wilful misconduct or gross negligence, or liability that the law does not allow to be excluded or limited.
7. Suspension, closure and deletion
7.1 If you breach art. 4, we may suspend the Account immediately and terminate the contract by notifying you by email (art. 1456 Italian Civil Code). We may also suspend the Account when this is needed to protect the Service or other people. These decisions are taken by a person.
7.2 You can delete the Account at any time, free of charge, by writing to info@oiler.education from the Account email: this is the only way we can verify that the Account is yours.
7.3 We may delete an Account whose code has never been used. The contract ends when the Account is deleted or when we close the Service or the functions that require the Account (art. 2.2).
8. Emails
We write to you at the Account email about the Service, for example with access codes and notices: these emails are part of the Service and you receive them for as long as you have the Account. You receive OILER news and offers only if you asked for them, and you can stop them whenever you like.
9. Changes to these Terms
We may change these Terms. We will tell you by email reasonably in advance, stating from when the changes apply: if you do not accept them, you can delete the Account; if you keep using it from that date, you accept them.
10. Assignment of the contract
We may assign this contract to whoever continues the Service, without reducing your rights: by accepting these Terms you consent in advance to the assignment, which we will notify to you by email (art. 1407 Italian Civil Code).
11. Applicable law and final provisions
11.1 These Terms are governed by Italian law; disputes fall to the court having jurisdiction under the law. Nothing in these Terms limits the rights that the law, including the law of your country, gives you and that cannot be excluded by contract, including, where provided for, the jurisdiction of the courts of the consumer's place of residence.
11.2 These Terms are published in Italian, English, French and Spanish; if the versions differ, the Italian text prevails.
11.3 If a clause is void or ineffective, the others remain valid. If we do not enforce a right immediately, we do not waive it. The Privacy notice explains how we process personal data and is not part of the contract.
